Terms of Service

1. Acceptance of Terms

By accessing or using PakGharana (“the Platform”, “we”, “us”), you agree to these Terms of Service. If you do not agree, please do not use the Platform. These Terms are a general framework and general guidance for using the Platform — they are not a substitute for legal advice specific to your situation.

2. What PakGharana Is

PakGharana is an online marketplace and advertising platform for property and new-development listings submitted by agents, developers, and property owners. We are not a real estate agent, broker, or party to any transaction, negotiation, or agreement between a buyer/tenant and a seller/landlord/ developer. Any transaction you enter into with another user — including any deposit, payment, or contract — is made directly between you and that user, entirely outside the Platform, and at your own risk. We have no control over, and are not responsible for, the conduct of any user, agent, developer, or property owner, on or off the Platform.

3. Eligibility & Accounts

You must be at least 18 years old to create an account. If you create an account, you’re responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Agents and developers represent that they have the legal right and any professional license or authorization required to advertise the properties or projects they list.

4. Acceptable Use

You agree not to:

• Post false, misleading, duplicate, or fraudulent listings, prices, or information.
• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Scrape, crawl, or use any automated tool, bot, or script to extract data from the Platform without our written permission.
• Use the Platform to send spam, unsolicited commercial messages, or harass another user.
• Upload viruses, malicious code, or attempt to interfere with, overload, or compromise the security of the Platform.
• Impersonate any person, or misrepresent your affiliation, ownership, or authority over a property.
• Copy, resell, or commercially exploit any part of the Platform or its listing data without our permission.

5. Listings & Content Are User-Generated

Property and project listings, including photos, videos, descriptions, and pricing, are submitted by agents, developers, and property owners, who are solely responsible for their accuracy. We apply a review and quality-scoring process before a listing goes live and may display badges such as “Verified” or a quality score — these reflect our internal review criteria only and are not a guarantee, certification, or warranty of a listing’s accuracy, legal status, ownership, condition, or continued availability. We do not independently verify title, ownership, or legal status of any property. Always independently verify a listing’s details, and the identity and legitimacy of the other party, before making any payment or entering any agreement.

6. Agent & Developer Listing Rules

Agents and developers must only submit listings for properties or projects they own or are genuinely authorized to advertise, and must keep listings accurate and up to date (including marking a listing sold, rented, or unavailable once it no longer applies). We may, at our sole discretion and without prior notice, reject, edit for compliance, suspend, or remove any listing or account — including for inaccurate, misleading, duplicate, or expired listings, or for any breach of these Terms — and reserve the right to refuse service to anyone.

7. Paid Placement & Subscriptions

We offer optional paid-placement tiers (such as Prime, Boost, or Featured listing/agent placement) that increase a listing’s or agent profile’s visibility on the Platform. Fees, current pricing, and available tiers are shown on our advertising pages and may change at any time. At present, payment for paid placement is arranged and processed directly with us offline (for example by bank transfer or invoice) — we do not process online payments through the Platform — and placement is activated manually once payment is confirmed. Paid placement affects visibility and ranking only; it is not a guarantee of any specific number of views, inquiries, leads, or a successful sale or rental.

8. Intellectual Property & License to Your Content

The PakGharana name, logo, and platform design are our property. You retain ownership of the listing content (photos, videos, descriptions, and similar material) you submit, but by submitting it you grant PakGharana a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to host, use, reproduce, display, distribute, and create derivative works of that content (for example, thumbnails or watermarked copies) for the purpose of operating, promoting, and improving the Platform. This license continues for content that remains cached, archived, or already distributed after a listing is removed.

9. Third-Party Links & Direct Communication

The Platform may link or connect to third-party services — WhatsApp, YouTube, a developer’s own website, or similar. Some contact options (such as “Call Agent” or “WhatsApp”) open a direct call or chat between you and the agent or developer through your own phone or WhatsApp app — that conversation happens entirely outside the Platform and is not something we operate, store, or have visibility into. We aren’t responsible for the content, policies, conduct, or practices of any third-party service or of any other user you communicate with, on or off the Platform.

10. Disclaimers

The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that listings are accurate, complete, or currently available.

11. Limitation of Liability

To the fullest extent permitted by law, PakGharana will not be liable for any indirect, incidental, or consequential loss or damage, including loss of profits, business, goodwill, or data, arising from your use of the Platform. We are not liable for any loss arising from a transaction, agreement, or dispute between you and any agent, developer, owner, or other user. Where liability cannot be excluded, our total liability for any claim relating to the Platform is limited to the amount (if any) you paid us directly in connection with that claim in the twelve (12) months before the claim arose.

12. Indemnification

You agree to indemnify and hold PakGharana harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: content or listings you submit; your breach of these Terms; your violation of any law or third-party right; or any transaction, dispute, or interaction between you and another user, agent, developer, or property owner.

13. Suspension & Termination

We may suspend or terminate access to the Platform for any account that violates these Terms, without prior notice where we reasonably believe it’s necessary to protect the Platform, our users, or third parties. You may stop using the Platform at any time; to request deletion of your account, see our Privacy Policy.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform will be subject to the exclusive jurisdiction of the competent courts of Pakistan.

15. Changes to These Terms

We may update these Terms from time to time. We’ll update the “Last updated” date above when we do. Continued use of PakGharana after a change means you accept the updated Terms.
